§1 General provisions

  1. These terms and conditions define the conditions under which contracts of sale and delivery of commercial goods are concluded through the Sperto s.c. online store available at https://www.sperto.pl.
  2. By placing an order, the Buyer confirms that he has read the contents of these terms and conditions and accepts their provisions.
  3. Sperto’s online store specializes in the sale of parts for catering machinery.

§2 The way of placing an order

  1. Buyer can place an order through:
  2. The order should include:
    • Buyer’s identification data (including VAT number),
    • email address,
    • specification of the ordered goods,
    • place of delivery.
  3. Orders are recorded and stored in accordance with applicable laws.
  4. The Seller may correct the order at the request of the Buyer if errors in quantity or quality are reported.

§3 Delivery date

  1. Delivery time depends on the availability of goods:
    • Parts from the warehouse are shipped by courier DPD and/or InPost:
      • Monday through Thursday from 8:00 am to 2:00 pm,
      • Friday from 8:00 am to 1:30 pm.
    • The warehouse does not work on Saturdays, Sundays and holidays.
  2. Each part has an assigned lead time visible on the website after logging in.
  3. The delivery times listed are for business days only. For example, a product ordered on Friday before 1:30 pm will be shipped the same day, but will arrive on Monday.
  4. Delivery time for “custom” products is determined individually.

§4 Method of payment

  1. You can pay for the ordered goods:
    • By electronic or bank transfer,
    • by credit card.
  2. Details of the method and timing of payment will be specified in the sales offer.
  3. In case of late payment, the Seller has the right to charge statutory interest for each day of delay.

§5 Withdrawal from the contract and complaints

Seller’s liability for non-conformity of goods with the contract in relations with entrepreneurs:
  1. The seller does not provide a warranty for the goods subject to the sales contract.
  2. The Seller shall be liable under the warranty only if the physical defect is reported before the expiration of 14 days from the delivery of the goods, subject to paragraphs 4 and 5.
  3. Complaints should be submitted on the form available after logging in on the website or by e-mail to biuro@sperto.pl.
  4. In case of assortment or quantity mistake, complaints should be reported within 3 days of receipt.
  5. Complaints about “custom” goods are not accepted.
  6. In case of damage to the goods during transport, it is necessary to draw up a damage report in the presence of the courier.
  7. Exceptions to the above provisions apply to individuals entering into a contract not professionally related to business.
Seller’s liability for non-conformity of goods with the contract in relations with consumers:
  1. The consumer has the right to withdraw from the contract within 14 days without giving any reason. A model withdrawal form is available at: https://www.sperto.pl/wp-content/uploads/2024/11/Formularz-odstapienia-od-umowy.pdf.
  2. To meet the deadline it is sufficient to send the statement before its expiration.
  3. In the event of withdrawal, the Seller shall refund all payments, including delivery costs, within 14 days.
  4. The consumer shall send back the goods within 14 days from the date of withdrawal. The cost of return shall be borne by the consumer.
  5. The consumer is responsible for the diminution in value of the goods resulting from their use.
  6. The right of withdrawal does not apply to personalized goods.
  7. A consumer may file a warranty claim if the goods have a physical defect in accordance with Article 556 of the Civil Code.

§6 Personal data protection

  1. The administrator of personal data is the Seller.
  2. Personal data is processed only for the purpose of processing orders and in accordance with data protection regulations.
  3. The buyer has the right to access and correct the content of his personal data.

§7 Final provisions

  1. In matters not covered by these regulations, the provisions of the Civil Code shall apply.
  2. The seller reserves the right to change the terms and conditions, and any changes will be published on the website https://www.sperto.pl and be effective from the date of publication.
  3. The regulations are effective as of October 16, 2024.
